That means you can’t use a name if it’s already been claimed by another registered company in your state.
In a similar vein, you should also ensure that your favorite business name idea doesn’t infringe on any protected trademarks. These happen at the state and federal levels. To check, you can run a trademark search on the United States Patent and Trademark Office’s website. Your state website will likely also have a similar tool.
Last but not least, it’s recommended to check if your online presence is workable. First, you should check if there is a domain name available for your favorite name. After that, check for social media handles that mirror your business name, too.

After you’ve picked your name, it’s time to officially register it. You have a couple different avenues for doing this, so let’s walk through the process.
The easiest way to legally claim a name is to register as a formal business entity like an LLC, corporation, or nonprofit (or another business type that files registration paperwork with the state). While every state varies a bit, the registration paperwork is usually called the “Articles of Organization” or the “Articles of Incorporation.”

If you’d rather operate as a sole proprietorship or partnership, you won’t be filing formation paperwork. Your options for claiming a business name are a bit more limited. For a lot of small business owners, filing a DBA, or “doing business as” name, is a viable option.
A DBA, sometimes called a trade name, fictitious name, or assumed name, is essentially a registered business nickname that lets you operate under a different name from your legal name.
The exact terms for a DBA vary from state to state, however. Some states protect DBAs for exclusive use, but many don’t. Some states don’t even require registration. Even if your state doesn’t protect DBAs, it’s still helpful to register one. Registering does add your name to the state’s records, which may discourage other businesses from using it.
No matter what type of business you’re forming, you have the option to register a trademark with the United States Patent and Trademark Office. This process is expensive and complicated, but it is the best protection you can get for your name. If you choose to go this route, you’ll likely need to hire an attorney to guide you through the process.
State trademarks apply only within the borders of your state, but they’re considerably easier to get than federal trademarks. The process varies by state, but it usually involves paying a small fee and completing a form.
